Federal Court Rules Colorado Law (Not Out of State Law) Applies to Damages Provision of UM Policy

In an important win for our client, the US District Court for Colorado recently granted our Motion for Summary Judgment that Colorado law —  not the out-of-state law the insurance company argued for  —  governed damages in an accident here in Colorado. The insurance company argued that because our client was from Missouri, Missouri law should apply to her underinsured motorist claim.  We argued that while it was a Missouri contract, the language of the policy implicitly incorporate Colorado law (where the accident took place).  The Federal Court agreed.  In this case —  and in every case we handle  —  we are ready to fight every battle to obtain a fair and reasonable result for our client!  Read the Order:   order granting motion for partial summary judgment
